A man who was arrested for selling a "Viagra-style drug" online in a Canadian town has been charged with 18 charges.
In a press conference, the court heard that police found a package in a store where the alleged seller was selling erectile dysfunction drugs, which were sold online. It was found to contain Viagra, which is sold as a drug for the treatment of erectile dysfunction, but is not approved for the treatment of the condition.
"The court has not found it to be a crime for the alleged seller to sell the drug online, but we do have evidence from this case that the man is selling the drug online from the Internet," said U. S. Attorney for the Eastern District of Pennsylvania. "We are having an intense search on the Internet for information about this product."
The court also heard that the man was charged with two counts of distribution of drugs that were illegally imported from India. The first count charged that he imported the drugs from India through the Internet and sold them to consumers in violation of the Sherman Act.
The second count also charged that the seller, known as a "Viagra-style drug," conspired with other Internet users to sell the drugs from the Internet, which they found to be counterfeit. The third count charged that the sellers of the drugs knew or should have known of their counterfeit or substandard drug products.
"Our firm believes that the alleged buyers of these drugs were engaged in a direct and anticompetitive relationship with each other and knew or should have known of the existence of these drugs," U. Attorney for the Eastern District of Pennsylvania said in a press release. "It is alleged that they were purchasing the drugs from a person who was unaware of the existence of the drugs. The drugs sold to these buyers were substandard. They were sold without a legitimate prescription and without the proper medical supervision."
The company that brought the case, Cipla Ltd., had already announced that it would not provide the alleged seller with a valid prescription for the drugs it purchased from the Internet. Cipla said it would not give the drug to anyone who purchased the drugs online. In a press release, Cipla noted that its drug sales database includes more than 700 products, including Viagra, Cialis, Celebrex, Stendra, Lyrica, Levitra, and more.
The court did not believe that the products purchased in the market were illegal drugs. The court said that a large percentage of Internet users have legitimate prescription drugs. The court did not know whether Cipla has a case against the seller of its Viagra-style drug for selling the drugs online.
A search of the Internet revealed that more than a dozen websites had been linked to online sellers selling drugs that were not approved by the Food and Drug Administration. Cipla had not yet announced that it was providing the drugs to consumers.
Cipla is not the first company to bring a case against Internet vendors. In October, a case against a seller of erectile dysfunction drugs in Germany was pending in federal court. The case was transferred to the U. District Court for the Eastern District of Pennsylvania, where it was consolidated with a case filed in the Eastern District of Pennsylvania.
